2026 BALLOT QUESTIONS
Frederick County voters will consider three proposed amendments to the Constitution of Virginia and one local school-funding referendum in the November 3, 2026 general election. The summaries below are written for readability and are not substitutes for the official ballot language.
PROPOSED CONSTITUTIONAL AMENDMENT 1 — REPRODUCTIVE FREEDOM
This proposal would amend the Virginia Constitution to protect decisions concerning prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care. It would permit restrictions on abortion during the third trimester, with exceptions involving the patient’s health or a pregnancy that cannot survive.
PROPOSED CONSTITUTIONAL AMENDMENT 2 — MARRIAGE EQUALITY
This proposal would remove Virginia’s constitutional prohibition on same-sex marriage, affirm that two adults may marry regardless of sex, gender, or race, and require legally valid marriages to be treated equally under Virginia law.
PROPOSED CONSTITUTIONAL AMENDMENT 3 — VOTING RIGHTS
This proposal would establish a fundamental right to vote in Virginia, provide automatic restoration of voting rights after a person convicted of a felony is released from incarceration, and replace the existing mental-competency provision with language applying to a person found unable to understand the act of voting.
FREDERICK COUNTY SCHOOL SALES-TAX REFERENDUM
Frederick County voters will decide whether the county may enact an additional local retail sales tax of up to one percent. Revenue would be restricted to construction or major renovation of Frederick County public schools, for a period of no more than twenty years.
